Last week, the court decided to overturn the decision by the Lower Silesian Voivode to reappoint Andrzej Chodyra as temporary manager of the Water and Sewerage Company (PWiK) in Bolesławiec. "We are waiting for the written reasoning. The voivode will presumably file an appeal," says Agnieszka Majcher from the Press Office of the Lower Silesian Voivode. Andrzej Chodyra himself believes that the Employee Council, which brought the case to court, did not have to immediately enter into conflict with the voivode. "We had to object to the reappointment, whether we wanted to or not. That is our role. The court accepted our arguments," explains Beata Raczyńska-Rzemek, Secretary of the PWiK Employee Council.

On the day the court issued its decision overturning the Voivode's decision, Andrzej Chodyra summarily dismissed his deputy, Piotr Hodowany. "The law says that the deputy and chief accountant may be dismissed only by the director with the consent of the Employee Council. No one informed us about this or asked for our consent," says Beata Raczyńska-Rzemek. As a result, the Council met and adopted a resolution suspending Chodyra's decision, and notified the voivode. "Every company head bears full responsibility for its operation and has the right to choose their staff. The dismissal was carried out lawfully. The temporary manager has the authority to dismiss a deputy. Only a court may assess whether this decision was justified," Andrzej Chodyra defends his decision. "As long as we are here, we must be taken into account," Beata Raczyńska-Rzemek replies.

A few days after the court's decision and Piotr Hodowany's dismissal, the Employee Council prepared an open letter. It wrote that the Temporary Manager does not inform it about the company's affairs and does not answer various questions. "It is exactly the opposite—the Council holds meetings without informing me and also organizes general staff meetings without me, thereby misinforming employees. It downplayed the information provided to it about the company's condition, which prevents commercialization," Andrzej Chodyra responds.

"The Council seeks to maintain the old arrangement. It is effectively trying to delay the commercialization process and the necessary recovery programs in many areas of the company. This includes putting the company's property matters in order; without this, the company cannot be commercialized," says Andrzej Chodyra. In his opinion, the company's assets are overstated. "No one has ever sought to clarify and put certain matters right," Andrzej Chodyra says in his defense. "We are not interested in any war. We only want the law to be observed," Beata Raczyńska-Rzemek replies.

Last year, Andrzej Chodyra replaced Józef Burniak, who had managed the company for three years. Chodyra served as temporary manager of PWiK until January 5 this year. During that time, the company's director was supposed to be selected through a competition. However, on January 5, voivode Krzysztof Grzelczyk reappointed Andrzej Chodyra as temporary manager of PWiK, a position he is to hold until the company's commercialization is completed.
