The Jelenia Góra District Prosecutor’s Office has discontinued the investigation into a traffic accident that occurred on May 6, 2006, in Ocice. To recap, Andrzej M., the commander of the Police Station in Bolesławiec, who was driving an Opel Astra, struck a pedestrian, Mariusz K., causing him bodily injuries.
During the proceedings, a road traffic expert was appointed, who determined that the police officer was responsible for causing the pedestrian collision. Andrzej M. had failed to maintain a safe speed while overtaking the pedestrians; however, the expert also stated that the injured party himself had contributed to the incident to some extent, as he and his friends were walking on the road contrary to regulations—that is, on the right-hand side.
As indicated by the opinion of experts from the Department of Forensic Medicine at the Medical University of Wrocław, the injured Mariusz K. sustained minor bodily injuries in the accident, impairing the functioning of his body for less than seven days. Therefore, given the nature of the injuries, the traffic incident caused through Andrzej M.’s fault did not constitute the offense of causing a traffic accident. The investigation was therefore discontinued.
During the proceedings, no evidence was gathered indicating that the police officer was under the influence of alcohol or intoxicated. The decision to discontinue the investigation is not yet final.
