Candidates for lay judges may be nominated to the Bolesławiec City Council by the presidents of the relevant courts, associations, and other social and professional organizations registered under the law, excluding political parties, as well as by at least fifty citizens with active voting rights who permanently reside in the city of Bolesławiec, by June 30 of this year.
The following documents must be attached to a lay judge candidate’s nomination submitted on the nomination form:
- a certificate from the National Criminal Register concerning the nominated person
- a statement by the candidate that no proceedings have been initiated against them for a publicly prosecuted offense or a fiscal offense
- a statement by the candidate that they have not been deprived of parental authority and have never had their parental authority limited or suspended
- a medical certificate concerning their state of health, issued by a physician referred to in Article 55(2a) of the Act of August 27, 2004 on healthcare services financed from public funds (Journal of Laws of 2008, No. 164, item 1027, as amended by Amendment No. 22), confirming the absence of contraindications to performing the duties of a lay judge
- two photographs meeting the requirements applicable when submitting an application for an identity card.
The listed documents must be dated no earlier than thirty days before the date of submission.
A nomination submitted on the nomination form by an association or another social or professional organization registered under the law must also include a current copy, dated no earlier than three months before the date of submission, from the National Court Register, or a copy or certificate confirming entry in another relevant register or record concerning that organization.
A nomination submitted on the nomination form by citizens must also include a list containing the first name or names, surname, PESEL identification number, permanent residence address, and handwritten signature of each of the fifty citizens nominating the candidate.
The elections of lay judges will take place no later than October of this year.
Before the elections, the City Council will appoint a committee that will present its opinion on the nominated candidates at a City Council session, particularly with regard to whether they meet the requirements set out in the Act.
