On 19 March, the District Court in Jelenia Góra sentenced a 44-year-old man accused of beating a 32-year-old victim resulting in death to 5 years in prison. In addition, the court ordered the convicted man to pay compensation to all the victims.
– The investigation was conducted by the District Prosecutor’s Office in Jelenia Góra, which in December 2022 submitted an indictment to the Court in this case – explains Ewa Węglarowicz-Makowska from the Jelenia Góra prosecutor’s office. – The man was accused of having, during the night of 16–17 October 2021 in Lubań, acting with direct intent, struck the victim in the head at least twice—with considerable force—causing him serious bodily injury in the form of an extensive subarachnoid hematoma with bleeding into the lateral ventricles of the brain.
These injuries resulted in the victim’s death.
In his closing statement, the prosecutor demanded an 8-year prison sentence for the accused. The spokesperson said: – However, the District Court in Jelenia Góra found that the perpetrator had committed the act while exceeding the limits of self-defense and therefore imposed a lower sentence.
The accused never admitted to committing the offense of which he was charged. He had not previously been convicted in Poland.

The prosecutor will submit a request for the written reasoning of this ruling. After reviewing its contents, she will decide whether to appeal the judgment to the Court of Appeal in Wrocław.
