A by-election is held only when a senator’s mandate expires. When a deputy’s mandate expires, their seat is taken by the candidate from the same list who received the next-highest number of votes. If two candidates have received the same number of votes, the order in which they appear on the list determines who takes the seat. A candidate may decline to accept the mandate; in that case, the next candidate on the list takes the seat. If there are no candidates left on the list, the seat remains vacant until the end of the term.
