Agricultural tractors—as used or unfit-for-use vehicles—were intended to be brought to Poland. Officers of the National Revenue Administration asked the WIOŚ Delegation in Jelenia Góra for an opinion on whether the cargo transported from France to Poland met the definition of waste.

The documentation submitted with the request showed that three burned agricultural tractors were located on the trailer. Following the inspection, it was established that the used or unfit-for-use vehicles had not been classified under any code pursuant to Regulation (EC) No 1013/2006 on shipments of waste. On this basis, the waste is classified as waste not included on the list.
The transport was deemed illegal. The reason? WIOŚ: “The import of waste into Poland that has not been classified under any code requires the application of the procedure for prior written notification and consent from the competent authorities.”
The case was referred to the National Revenue Administration, which is carrying out further proceedings.
