Adam Ciemięga is a doctor in Zebrzydowa. The case concerned the fact that he privately saw patients and conducted driving-licence examinations at a public clinic. According to the prosecutor’s office, he earned eight thousand zlotys this way. The case had been pending since 2004 and ended with a conditional discontinuation of the proceedings. The doctor had to pay one and a half thousand zlotys into the facility’s account. The judgment became final in September last year.
“I lived with a sense of peace. I had no information or knowledge whatsoever about the consequences of the judgment. If I had known, I would not have been able to conceal it. I will submit a letter to the County Council asking it to investigate the situation. I will comply with the council’s decision. If it is necessary to return the allowances, I will of course return them,” Adam Ciemięga told the IstotneInformacje.pl portal Adam Ciemięga.
The councillor will lose his mandate because, when the judgment conditionally discontinuing the proceedings was issued, he lost his eligibility to stand for election. This results in the expiry of his mandate. The County Council should have adopted an appropriate resolution on the matter within three months, but nobody notified the council that the councillor’s trial had ended. The councillors will address the matter at the next session.
The case concerning the expiry of Adam Ciemięga’s mandate is identical to that of municipal councillor Józef Burniak. A judgment conditionally discontinuing the proceedings was also issued against him, and on 27 August the councillors will vote at a session on a resolution concerning the expiry of Burniak’s mandate.

In connection with information that appeared on the websites istotneinformacje.pl, bolesławiec.wfp.pl, polskatimes.pl and bolesławiec.naszemiasto.pl, I hereby inform you that the Chair of the Bolesławiec County Council has taken steps to clarify matters related to councillor Adam Ciemięga’s mandate.
I also inform you that if the content of the judgment corresponds to the provisions of Article 7(2) of the Act on the Election of Municipal, County and Voivodeship Councils, Mr Adam Ciemięga lost his councillor’s mandate by operation of law pursuant to Article 190(1)(3).
If the information provided by the aforementioned media is confirmed, the Bolesławiec County Council will adopt an appropriate resolution terminating the mandate at its next session.
