The tragic incident took place in Bolesławiec on the night of October 26–27, 2014. The perpetrators tricked the woman and her cohabiting partner into leaving the apartment and going into the courtyard, where they were waiting for them in a car parked there.

When the victim and her partner approached the vehicle, Arkadiusz D., whom they knew, got out. Dariusz P. and Piotr Z., who was behind the wheel, remained in the car. Arkadiusz D. pushed the man away, then grabbed the woman by her clothing and forcibly pushed her onto the back seat of the vehicle against her will. The perpetrators then quickly drove away toward the city bypass.

After reaching their destination, Arkadiusz D. undressed and then began beating the victim all over her body with his hands, pulling her hair and twisting her arms, thereby forcing her to have sexual intercourse first with him and then with Dariusz P. All the men, including Piotr Z., threatened their victim, saying that if she did not follow their orders, they would kill her and bury her in the forest.

The perpetrators then drove the woman back to her home. The following day, October 27, 2014, one of the accused—Arkadiusz D.—telephoned the raped woman’s partner and began threatening him and the victim, saying that if they reported the incident to police officers, they would first beat them and then kill them. These threats gave them reasonable grounds to fear that the accused might carry them out. Despite this, the victim decided to notify the Bolesławiec County Police Headquarters of the crime. Police officers immediately arrested all three perpetrators of the rape.

At the request of the District Prosecutor in Bolesławiec, the court ordered pre-trial detention for all three men.
The crime with which they are charged carries a sentence of between 3 and 15 years’ imprisonment.

In addition, during the investigation it was established that on October 7, 2014, in a town near Bolesławiec, Arkadiusz D. caused a collision with an oncoming delivery vehicle driven by Stanisław D.

The man injured in the incident told Arkadiusz D. that he would not call the police if Arkadiusz D. compensated him for the damage caused, namely paid 300 zlotys for the damaged side mirror. The offender stated that he could give him only 90 zlotys. Stanisław D. then informed him that he was calling a police patrol. On hearing this, Arkadiusz D. began threatening the man, using vulgar words and phrases, saying that if he did so, he would beat him and then kill him. He also threatened other people who had witnessed the collision he had caused. This aggressive behavior caused Stanisław D. and the other people to have reasonable grounds to fear that the threats he had made might be carried out.
Arkadiusz D. and Dariusz P. had previously been convicted. Piotr Z., however, will be appearing in the dock for the first time.
