In January 2014, the victim met the defendant, who was 17 at the time, through an internet messenger. Contact between the teenagers began at the girl’s initiative, as she was the first to send the boy photos of herself with parts of her body partially exposed. As time passed, their virtual acquaintance became increasingly intimate. The young people, who knew each other’s ages, exchanged various pieces of information concerning their private and intimate lives, and also sent each other erotic photos, although this was mainly at the defendant’s initiative.
In February 2014, when the girl moved with her family to a new place of residence, she met the defendant for the first time at his grandmother’s apartment in Legnica. During the meeting, at his initiative, sexual intercourse took place. From February to October 10, 2014, the defendant had intercourse with the 13-year-old at least six more times, taking advantage of her submissive personality. The boy imposed on the girl the type of sexual relations, her clothing and the time at which the encounter was to take place. In the period before the summer holidays (the previous year), the victim systematically limited contact with the teenager. She did so because of the defendant’s increasingly intrusive and vulgar manner, expressed during conversations held through an internet messenger.
When she eventually ended contact, the boy pressured her to resume their meetings. Living under constant psychological pressure from her former boyfriend, the girl finally, with her sister’s support, told her mother everything in October 2014, and her mother notified law enforcement authorities.
Furthermore, on April 26, 2014, after one of the meetings, the teenager used his mobile phone to record an act involving another sexual activity committed against the minor victim. In addition, the defendant regularly viewed pornographic content posted on the internet, as a result of which, on July 10, 2014, he came into possession of two films involving minors under the age of 15, depicting sexual intercourse and other sexual activities, and stored them on his mobile phone.
The teenager was charged with pedophilia, namely sexual intercourse with a minor under the age of 15, as well as recording and possessing pornographic material involving minors. Questioned as a suspect, he confessed to the acts of which he was accused and gave explanations.
The defendant also expressed his willingness to voluntarily submit to punishment and agreed to the conditions arranged with him in this regard. In view of the fact that the circumstances of the acts were not in doubt, the offender’s young age and his previous lack of a criminal record, it was agreed with the defendant that he would receive a combined sentence of two years’ imprisonment, conditionally suspended for a three-year probation period, be placed under probation officer supervision during the probation period, be prohibited from approaching or contacting the victim for three years, and forfeit his mobile phone.
The case will be heard by the District Court in Legnica.
